These terms apply to the Kühler Pro app, also called PROJECT BOSCO, operated by Kuhler Technologies, Inc. ("Kühler", "we"). By creating an account or saving data you agree to them. Nothing here limits rights you have under consumer law that cannot be waived.
1. Who can use the app
You must be 18 or older. The app is offered as an early beta and may change.
2. Your account
Keep your sign-in details private and tell us at info@getkuhler.com if you think someone else has accessed your account. You are responsible for activity under your account that you authorize.
3. Permitted use
Use the app for your own training and, where you are a coach or team owner, for athletes who chose to share with your team. Do not misuse the service, attempt to access other people's data, reverse engineer the models or overload the service.
4. Data you upload and imports from other services
Only upload files and data you are entitled to provide, such as your own Garmin, WHOOP, CORE or weather records. Imports are read from files you choose; the app does not connect to those services. Their terms continue to apply to your use of them. You keep your rights in your data. You give us permission to store and process it to provide the app to you, as described in the Privacy Notice. Any use to improve shared algorithms requires your separate, optional permission.
5. Estimates, not medical advice
Thermal Risk scores, cooling plans, performance forecasts and physiological estimates are model outputs. Individual responses vary, and results may be lower, zero or negative. The app does not diagnose or treat any condition, is not a medical device, does not provide emergency or real-time monitoring and does not guarantee performance or safety. Stop and seek help if you feel unwell, and follow any heat rule that applies to you. See Estimates & limitations.
6. Our intellectual property
The app, its design, content, models and algorithms belong to Kühler or its licensors. You may use them only through the app.
7. Sharing
Sharing with a team or sharing an image is always your choice. Team members see only what you share with that team.
8. Changes, suspension and deletion
We may change or discontinue features. We may suspend access for misuse or security reasons. You can export or delete your data in Account & data at any time. When these terms change materially, we will ask you to accept the new version before your next save.
9. Kühler hardware
Purchases of Kühler devices are governed by the terms of the store where you bought them and the applicable product warranty, not these app terms.
10. Warranty and liability
To the extent permitted by law, the app is provided "as is" during this beta, without warranties of accuracy or fitness for a particular purpose. To the extent permitted by law, Kühler is not liable for indirect or consequential losses arising from use of the app. These limits do not apply where the law does not allow them, including liability that cannot be excluded for death or personal injury caused by negligence, fraud, or your statutory consumer rights.
